Membership Terms and Conditions
This document outlines the membership terms and conditions at Eastside Outdoor Fitness.
These terms and conditions apply from the date you indicate your acceptance on the Website or Member App.
Members must be aged 16 or older on the day of membership commencement.
1. Definitions
1.1 “Eastside Outdoor Fitness” means East London Outdoor Fitness Ltd.
1.2 “Home Venue” means the venue or park to which your membership is assigned.
1.3 “Member” / “You” means an individual with current membership.
1.4 “Member App” means the mobile or online application used by Eastside Outdoor Fitness made available to you.
1.5 “Website” means www.eastside.fit
2. Membership
2.1 Membership
2.1.1 Your membership of Eastside Outdoor Fitness starts on the date you make a payment.
2.1.2 Your membership renews automatically on the same terms unless you suspend, cancel, or transfer in accordance with clause 6.
2.1.3 From time to time, we may offer discounted membership types subject to qualifying criteria. Details will be shown on the Website.
2.1.4 Any discounted membership conditions will be verified by us before any discounted rate is applied.
2.1.5 Some membership types may not be available at all venues. Please contact us for details.
2.2 Membership Types
Legacy Memberships (Annual and 3-Monthly)
2.2.1 Annual and 3-Monthly memberships are no longer available for new purchase, advertisement, or transfer to existing members.
2.2.2 Annual memberships: existing annual members may retain their membership and will be offered a renewal quote each year. Once paid in full, fees are non refundable.
2.2.3 3-Monthly memberships: existing 3-monthly memberships will continue to roll over automatically every three months under their current terms. They remain active unless cancelled and are subject to future price increases with a minimum of 30 days’ notice.
2.3 Current Monthly Memberships
2.3.1 Cancel Anytime (No Contract): monthly subscription that renews automatically each month; may be cancelled at any time with immediate effect.
2.3.2 30-Day Cancellation: monthly subscription that renews automatically each month; requires 30 days’ notice to cancel.
2.3.3 90-Day Cancellation: monthly subscription that renews automatically each month; requires 90 days’ notice to cancel.
2.3.4 All memberships renew according to their billing cycle unless a cancellation request is received in line with the relevant notice period.
2.4 Packages
2.4.1 You may purchase class credits for a single class or in packs of 1, 5, or 10 classes.
2.4.2 Payment must be made in advance by credit or debit card to our authorised collection agent.
2.4.3 Credits become available once payment is processed and remain valid until used or until the validity period expires, whichever is sooner:
2.4.3.1 Single class: valid for 1 month from purchase.
2.4.3.2 Pack of 5 or 10 classes: valid for 3 months from purchase.
2.4.4 Unused credits automatically expire at the end of the validity period and cannot be used thereafter.
2.4.5 Class credits are non transferable and non refundable.
3. Venues and Classes
3.1 You must book via the Member App or Website before attending any class.
3.2 If you cannot attend a booked class, you must cancel as soon as possible via the Member App or Website. We may restrict future bookings if you fail to attend up to three classes without cancelling.
3.3 Waiting lists may be available. When a space opens, those on the list will be notified on a first-come, first-served basis.
3.4 Your membership is assigned to your Home Venue and may not be used outside your assigned venue and timetable.
4. Class Timetables
4.1 We may need to change timetables from time to time. Where possible, we will give notice. If published classes are unavailable at your Home Venue or a venue within a 20-minute drive for at least 10 days in any 30-day period, you may be entitled to an appropriate prorated refund.
5. About Your Membership Fees
5.1 Monthly Membership Fees and Advance Payments
5.1.1 All members, whether paying annually or monthly, will pay a joining fee.
5.1.2 Membership fees are taken on the date of joining.
5.1.3 Payment may be made by debit or credit card, or by direct debit collected by our authorised collection agent or its nominee.
5.2 Missing Membership Fee Payments
5.2.1 If a collection attempt fails, our agent (or its nominee) will make up to three further daily attempts. After three unsuccessful attempts, we will suspend your membership.
5.2.2 We may refer missed payments to a third-party debt collection agency.
5.2.3 If you are more than 30 days in arrears, we may charge an administration fee of £30 plus VAT.
5.3 Fee Changes
5.3.1 We review fees periodically. We will give at least 30 days’ written notice of any change. You may cancel within 14 days of receiving our notice by providing written notice if you do not agree to the new fees.
6. Suspending, Cancelling, or Transferring Your Membership
6.1 Suspending Your Membership
6.1.1 You may suspend for prolonged absence such as serious illness or injury. Suspension is for full calendar months only, minimum one month, maximum three months.
6.1.2 Suspension may start from your next payment date if you give at least seven days’ written notice before that date.
6.1.3 If notice is received less than seven days before your next payment date, suspension will start on the same date of the following month.
6.1.4 For medical reasons, we may allow a longer suspension up to a maximum of twelve months with evidence (for example a doctor’s certificate). Suspension will begin from the next available payment date after we receive evidence.
6.1.5 You must provide a restart date. Payments will automatically recommence on that restart date. You are responsible for ensuring we have received written notice of both the suspension and the restart date.
6.1.6 Any suspension longer than three months will result in cancellation of your membership and may result in the loss of any preferential terms previously held.
6.2 How to Cancel Your Membership
6.2.1 To cancel, you must notify us in writing by email to info@eastside.fit. Verbal cancellations or cancellations by any other method will not be accepted.
6.2.2 You must give notice in line with your membership type:
• Cancel Anytime (No Contract): may be cancelled immediately.
• 30-Day Cancellation: 30 days’ notice required.
• 90-Day Cancellation: 90 days’ notice required.
Legacy Rolling 3-Monthly: 90 days’ notice required. Annual Supersaver memberships are non refundable.
6.2.3 All notice periods commence from your next renewal date (the date your next payment is due) and run for the length of the required notice period.
6.2.4 Emails received after 17:30 are deemed received on the next working day. You are responsible for ensuring we have confirmed receipt of your cancellation email.
6.2.5 Cancelling your direct debit or card payment does not constitute notice. If you stop paying without giving notice under this clause, you remain liable for fees due for the duration of the notice period.
6.3 Changing Your Home Venue
6.3.1 Memberships are personal and cannot be assigned or transferred to another individual.
6.3.2 You may change your Home Venue. The change takes effect on your next payment date and you will be charged the prevailing fees for the new venue.
7. Our Right to Cancel Your Membership
7.1 We may cancel your membership immediately if you:
7.1.1 Breach these terms and conditions.
7.1.2 Put the health, safety, or wellbeing of members, employees, or contractors at risk.
7.1.3 Allow another person to use your membership to attend classes.
7.1.4 Use rude or abusive language, or behave or threaten to behave violently or aggressively at any venue, or direct such behaviour towards staff, including via social media.
7.1.5 Fail to make payments as outlined in clause 5.
8. Your Responsibility for Your Possessions
8.1 You bring personal possessions to the venue at your own risk. We do not accept responsibility for possessions that are lost, damaged, or stolen at the venue, including items stolen from our vans or any other vehicle operated by an instructor.
9. Accidents and Injuries
9.1 If you have an accident or injury at a class, you must report it to the instructor immediately.
9.2 You must follow all health and safety instructions given by instructors.
9.3 We do not accept liability for injury or death at our classes except where caused by our negligence or failure to take reasonable care.
10. Your Personal Information
10.1 Details of how to access or amend your personal information are set out in our privacy policy on the Website.
10.2 You are responsible for informing us of changes to your personal information.
10.3 Eastside Outdoor Fitness may use video or photographic imagery captured at its activities for social media, advertising, marketing, and other promotional purposes.
11. Changes to These Terms
11.1 We may change these terms and conditions from time to time. We will give notice of significant changes and publish the updated terms on the Website.
11.2 Notification of updates will be sent by email. Your continued use of your membership or participation in any classes after receipt of that email will constitute acceptance of the updated terms and conditions.
